1. Acceptance
By using ProfilePics (profilepics.app), you agree to these terms. ProfilePics is operated by Nira Labs. If you do not agree, do not use the service.
2. Service Description
ProfilePics uses artificial intelligence to generate professional headshots from photos you upload. We offer instant generation (no training) and studio-quality generation (with AI model training on your photos).
3. Your Account
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use this service.
4. Photos and Content
Your uploads: You retain ownership of all photos you upload. By uploading, you grant us a limited license to process your photos solely for the purpose of generating headshots.
Generated images: You own the headshots we generate for you. You may use them for personal or commercial purposes (commercial use requires the Premium tier).
Restrictions: You must only upload photos of yourself or photos you have permission to use. Do not upload photos of other people without their consent.
5. Payments and Credits
ProfilePics uses a credit-based system. Credits are purchased through Stripe and are non-refundable once used for generation. Unused credits remain in your account indefinitely.
Prices are listed in Indian Rupees (INR) for India and may vary by region. All payments are processed securely by Stripe.
6. Refund Policy
If AI generation fails or produces no usable output due to a technical error, your credits will be automatically refunded to your account. We do not offer refunds for subjective dissatisfaction with generated images, as AI output quality varies based on input photo quality.
For credit purchases where no credits have been used, you may request a full refund within 7 days of purchase by contacting support.
7. Acceptable Use
You agree not to:
- Upload illegal, harmful, or explicit content
- Generate images that impersonate others or create deepfakes
- Use the service for fraudulent purposes
- Attempt to reverse-engineer our AI models
- Abuse free tiers or circumvent usage limits
- Resell generated images as an AI headshot service
8. AI-Generated Content Disclaimer
AI-generated headshots are artistic interpretations, not photographs. While we strive for photorealistic quality, generated images may not perfectly represent your appearance. We make no guarantees about the suitability of generated images for specific purposes (e.g., passport photos, legal identification).
9. Service Availability
We aim for high availability but do not guarantee uninterrupted service. AI generation depends on third-party providers (fal.ai, Replicate) which may experience downtime. We are not liable for losses due to service interruptions.
10. Limitation of Liability
ProfilePics is provided “as is” without warranties of any kind. Our total liability is limited to the amount you paid for the service in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.
11. Termination
We may suspend or terminate your account for violations of these terms. You may delete your account at any time. Upon termination, your photos and generated images will be deleted within 30 days.
12. Changes to Terms
We may update these terms from time to time. Continued use of the service after changes constitutes acceptance. Significant changes will be communicated via email.
13. Governing Law
These terms are governed by the laws of Australia. Disputes will be resolved through the courts of New South Wales, Australia.
